If the court approved Dish's new design, it would apparently
allow the satcaster to operate its DVRs without change. However,
TiVo would likely appeal the ruling -- and Dish would probably
still be liable for past damages.
Business Week reports that TiVo has filed a request with the
U.S. Court of Appeals, asking that Dish's DVR service be stopped
immediately.
